These Terms and Conditions ("Terms") govern your use of our website, mobile applications, dynamic QR code profiles, and physical eco-planting services operating within the Republic of South Africa. By accessing or using our Services, you agree to be bound by these Terms and comply with all applicable local regulations.

1. Definitions
"Company" refers to Tree of Life, an entity in South Africa.
"User" refers to visitors, customer accounts, donors, and corporate clients.
"Content" refers to text, photos, videos, and links uploaded to dynamic QR code profiles.
"Planting Projects" refers to the physical ecosystem restoration and tree planting initiatives.

2. POPIA Compliance & Digital QR Services
Data Protection: In accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA), we are committed to safeguarding your personal data. Media, names, and contact information uploaded to memorial QR codes are processed only with explicit user consent.

Content Responsibility: You retain ownership of all media uploaded to your dynamic QR profiles. You may not upload defamatory, offensive, or copyright-infringing content that violates South African law. We reserve the right to remove any digital content deemed harmful or non-compliant with POPIA or national security laws without prior notice

3. Physical Tree Planting & Land Ownership Disclaimer

No Property Rights: Sponsoring a tree or funding a regreening project does not grant the User or any beneficiary legal ownership, land rights, or titles to the physical land where the trees are planted.

4. Fundraising, CPA, & Donations
Transaction Processing: All financial transactions, donations, and campaign payouts are processed securely through South African Bank-compliant payment gateways; the company does not handle any donations, it only links users to other payment platforms.

5. Governing Law & Jurisdiction

These Terms are governed by, and construed in accordance with, the laws of the Republic of South Africa. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the South African courts.
